Terms of Service

1. Provider and scope

DoOrDonate (the "Service") is operated by Finn Strehl, Kaiser-Friedrich-Ring 142, 40547 Düsseldorf, Germany (trading as Strehl Digital — "we" / "us"). These Terms govern your use of the DoOrDonate website and mobile application. By creating an account or starting a challenge you agree to these Terms. If you do not agree, do not use the Service.

2. The Service

DoOrDonate lets you create personal accountability challenges with a financial stake. You set a goal, a schedule, and a stake amount. If you complete your challenge by submitting the required proof on time, no payment is taken. If you fail, your saved payment card is charged and 91% of the stake is donated to the charity you chose; 9% is retained as a platform fee to cover operating costs.

4. Right of withdrawal

If you are a consumer resident in the European Union you have the right to withdraw from a contract for digital services within 14 days of its conclusion without giving any reason (§ 312g BGB; Art. 9 Consumer Rights Directive 2011/83/EU).

Waiver for digital services commenced immediately: When you tap "Save card & start", you expressly request that we begin performing the service — activating your payment authorisation and starting your challenge — before the 14-day withdrawal period expires. By proceeding you acknowledge that you thereby waive your right of withdrawal once performance has commenced (§ 356 Abs. 5 BGB). If you do not wish to waive this right, do not start a challenge before the 14-day period has elapsed from account creation.

When you start a challenge you authorise us to charge your saved payment card if you fail to complete the challenge. By tapping "Save card & start" you confirm that:

6. Proof submissions

You must submit one proof per required challenge day using the proof type you selected at creation (photo, location check-in, or timer completion). Failure to submit by 23:59:59 (your local device time) on a required day counts as a missed proof. A challenge is settled as failed when the number of submitted proofs falls below the required count at the time of settlement. We reserve the right to review submitted proofs for reasonable compliance with the stated goal.

In the event of a technical outage on our side that prevents timely proof submission, we will extend the applicable deadline and notify affected users by email.

7. Payments and platform fee

All payments are processed by Stripe, Inc. By saving a card you agree to Stripe's Terms of Service. Stakes are charged in EUR. A platform fee of 9% covers operating costs; the remaining 91% is transferred directly to the selected charity's Stripe Connect account. DoOrDonate never holds funds on behalf of charities — all transfers occur within Stripe's infrastructure.

8. Charities

Donations are forwarded to verified partner charities via Stripe Connect. If a selected charity becomes unavailable after your challenge has started, we will forward the donation to an equivalent partner charity and notify you by email within 7 days of settlement.

9. Consumer information (Art. 246a EGBGB)

Main characteristics: Personal accountability challenges with a conditional financial stake; proof verification via photo, location check-in, or timer (your choice); donation to charity on failure.

Total price: The stake amount you set (minimum €5). No additional fees are charged to you — the 9% platform fee is deducted from the failed-challenge payout, not added on top.

Contract duration: Each challenge runs for the duration you select and ends upon settlement (completion or failure). Your account contract runs indefinitely until you delete it.

Digital functionality: The Service requires an internet connection and a compatible iOS or Android device. Proof photos are stored in EU-based cloud storage (Supabase, Frankfurt).

10. Account and termination

You may delete your account at any time from the profile screen. Any active challenge with a pending payment authorisation will be settled before deletion is finalised. We may suspend or terminate accounts that violate these Terms, with prior notice except in cases of serious or repeated violations.

11. Liability

Our liability is unlimited for damage caused by intent (Vorsatz) or gross negligence (grobe Fahrlässigkeit), for injury to life, body or health, and for claims under the German Product Liability Act (Produkthaftungsgesetz).

For damage caused by simple negligence (einfache Fahrlässigkeit), our liability is limited to breaches of a fundamental contractual obligation (Kardinalpflicht) whose fulfilment is essential to the proper execution of the contract and on whose compliance you may regularly rely. In such cases our liability is capped at the foreseeable, contract-typical damage at the time of contract conclusion.

Any further liability is excluded.

12. Changes to these Terms

We may update these Terms for legitimate reasons such as legal changes, new features, or security improvements. We will notify you of material changes by in-app notification or email at least 30 days before they take effect. If you do not object within this period and continue using the Service, the updated Terms are deemed accepted. You always have the right to terminate your account before new Terms take effect.

13. Dispute resolution

The European Commission provides a platform for online dispute resolution (ODR) at ec.europa.eu/consumers/odr. Our email address is strehldevs@gmail.com.

We are neither willing nor obligated to participate in dispute resolution proceedings before a consumer arbitration board (§ 36 VSBG). We encourage you to contact us directly — we aim to resolve all issues amicably.

14. Governing law

These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection provisions of the EU member state in which you reside remain unaffected. Exclusive jurisdiction for disputes with merchants (Kaufleute) and business customers is Düsseldorf, Germany.
